DEAR PAUL AND KEN:

As Paul and I discussed, enclosed is the waiver of service form with the changes Paul requested. Also enclosed are two duplicate originals of the certiorari petition and supporting papers we filed today. Again, we must perfect service within five days, so please return this to us immediately in the enclosed self-addressed, postage prepaid envelope. If there is any problem, please call me at once.

As a precaution, we decided to name Mr. O’Brien as an additional defendant. If he need not be named to comply with the certiorari statutes, we can dismiss him in due course. We are requesting that he waive service also, although we have requested personal service on him due to the short time-frame.
