Milton man denied in request to trade noise for sewer.

The Milton City Council applauded a Bethany Road resident for his creative presentation, but it didn't reward him.

On Monday night at a monthly work session, the council rejected Tim Enloe's request to obtain a sewer line in compensation for his claim of noise abatement coming from nearby and newly opened Milton High School.

To make his point, Enloe showed a video in which he played Kermit the Frog and Billy Bob Thornton.

Enloe said the blare of the band and incessant shouting over the loudspeakers has disrupted life for him and his family.

"Peace and quiet has been stolen from us," he said. "It's hell."

Enloe next asked the city to allow sewer on his property to compensate for the noise disruption. Council members congratulated Enloe on his presentation. But they were unmoved by his request.

Mayor Joe Lockwood said the issue was noise, not sewer. Lockwood wouldn't grant a variance for sewer lines on the property, but said he would join other council members and contact the school. Yet the city has no jurisdiction over the school property, he said.

Enloe's sewer request was prompted in part by the council voting 4-3 on May 3 to allow sewer service to eight land parcels within the city. The vote, which followed nearly an hour of debate and discussion, ended one argument in the city's negotiation with Fulton County over a state-mandated service agreement. The Service Delivery Strategy is now in court-ordered mediation.

Milton and Fulton County have disagreed on sewer service since the city was founded. Sewer is seen by many residents as the first step to uncontrolled growth.

Also, city officials heard an update on a revised ordinance governing cell phone towers. The new ordinance would require more stringent reviews of applications, height and setback restrictions and a new fee structure.

The city voted in March to place a moratorium on cell tower permits until it can revise its ordinance.

On April 26, after nearly four hours of debate involving a capacity crowd, the council granted permission to T-Mobile South to build one of three proposed cell phone towers.

The council said that tower, located at 13302 New Providence Rd., would be restricted to 100 feet in height and require an engineering plan for wind load requirements.

I'm not sure but there was not too much said about sewer,if anything. This whole thing was again about the school noise? Was I misreading the article title?

I think what he is saying is that what they purchased their property for is not what they are getting, after 33 years. And that they cannot sell their property without divulging all the noise and trash and speeding they experience on a daily basis, so what other option do they have. Stay and have their every day life disrupted as it has changed dramatically from what it was years ago, before MHS, or move. Well how can he move and market his property to other homeowners wanting tranquility and that "rural" atomosphere we are so famous for out here? he can't. So he wants sewer, and now you say he can't have it. so I guess he is stuck and has to just put up with the situation? I get it, not sure why council doesn't. Let him have sewer so he can sell his property and move somewhere else where it is more quiet and peaceful. He has that right.

yeh sounds great but how many other propertys would he have to go through to get sewer? and bethany road does start going downhill right about in front of his house so hes kinda pushing the envelope

Of course, the meeting was only a "working session" where no decisions are made. There still is an opportunity for Tim to make his case in a regular council meeting.

Unless you live on Bethany Rd., then it's not any ones business what goes on there. Tim has fought for rural lifestyle and peace and quiet and now that he's not getting it anymore he wants to open up the marketing of his house to more potential buyers so that is why he wants sewer. That would mean he is selling out to all his other neighbors and opening his property up to subdividing it into several parcels or selling out to some type of retirement home. Screw his neighbors who have stood behind him for the last 3 years fighting for what we all believe in. He is not a happy camper about Milton High School. Even before Milton moved, we got trash on our properties, kids driving through our yards and traffic. Milton is one of his excuses and everyone is tired of hearing from him. We do not want sewer extension on parts of Bethany and if we have to write a letter to Lynne Riley and the mayor and Council then we will.

It's time to market his house and see what he can get for it and move on.

Yet you are telling Tim it is time to market his property and move on? You do not have the right to tell him what to do with his life and property.
If you say that you do because you are one of the bordering properties then I will tell you that my road borders yours and I have just as much say in your property and what you do with it.

You are obviously a Bethany resident so your first statement is bizarre.

If he wants to apply for sewer then that is his right. There are others that live on and around Bethany road who share Tims point of view.
I do not live on Bethany and I have been more of a support to Tim than yourself. I know what he and his family have been going through over the years. Did you ever offer to help him with his concerns? He certainly has tried to help with yours. Instead you tell such an upstanding neighbor to move away?
I would be thrilled to have a watchdog like him on my road. Someone to help me lead the charge on improving the living conditions in my area. You should be thanking him for the time and effort he has put in over the years addressing your problems and concerns.
I do not blame them for wanting sewer. Look what they have to live near. Not to mention a neighbor such as yourself who did not stop to ask “How can I help” instead of throwing fuel on the fire.

Shame on you.

Let's just get down to the facts!!!!!!!!!!!!!!I am a neighbor and I did sign the petition for sewer extension, but have voiced my concerns to Tim about what he wants to do for his property. I have lived here 39 years and I believe I do have a right to know what he wants and who he wants to sell his property to and what reason. Believe me if Tim were in my shoes and I wanted to sell out commercial he would be on the band wagon to stop me. Rural, rural, rural, that's all we hear until he does not get his way with sewer and getting the noise from the school (in which he hates with a passion) stopped. I have supported Tim up to now and now I feel like he is selling out to all his neighbors and I do feel like I have the right to fight him if he sells out other than for residential. What if I wanted to put a cell tower in my back yard that everyone could see, would you be there supporting me or fighting me. I believe I have just as much right to fight Tim than you have to tell me I don't have the right. I will fight for not having sewer on Bethany Rd, because I am NOT going to sell out to the highest bidder and leave my neighbors. I plan on being here the rest of my life!

THis is an interesting debate. Couple of aspects - one is screwing your neighbors and the other sewer extension.

I remember when we moved to Alpharetta/Milton a number of years ago. We owned a house in a quiet neighborhood about 1/2 mile from Kennesaw State University. I had a chance to refinance my house payment down to $500/mo and then rent it out to KSU students around $850 to $1k/month. I debated doing it but didn't because I didn't want to do that to my neighbors. But that was my choice and one that I don't think anyone should have made for me...so if Tim wants to screw his neighbors, then thank God he lives in a free country (for now anyway) and can do so. And we are all welcome to judge and condemn him on his own site too :-)

On the sewer. I had always kind of laughed at the JZB hysteria but I think this thread opened my eyes to the potential for sewer creep that she warns about. If they were to grant this to Tim then anyone could get it. Once his propery turned into a retirement home - the next one up the street and behind and in front would qualify under the same or maybe new reasons.

Solution here is to obviously get MHS to tone down the noise. Seems it could be a pretty simple solution - perhaps Tim has some suggestions?

This is a free country and hopefully will always be one. I am saying what you are talking about. There are 39 acres at the corner of Bethany Rd. and Mayfield Rd. that are owned by an elderly couple. One day their 3 sons will inherit this property. Does anyone want to see townhomes, assisted living, etc. on this property which will definitey bring on much more traffic on Mayfield and bethany Rd. which is what Tim is complaining about now. Our end of Milton is residential all around and beautiful property. I don't think anyone wants commercial around here.

I believe that if the noise could be quitened down from Milton High that it would make Tim more happier where he lives. But what I am saying is that if he does not get this done than what we have all supported him on, he will not care anymore. And that my folks is the truth. Once again I have supported Tim on everything. But not sewer!!!!!!!!!!!!!! Not anymore.

All:

Let me clarify a few things:

1. We DO NOT want to move.
2. We just want the quiet back that we purchased 33 years ago.
3. If we cannot have that and we market our property, we have to disclose the noise issue. This hinders our market considerably.
4. To compensate for what has been taken away from us, we have to add something to it to get us back to square one. Sewer would be that option.
5. The majority of neighbors on Bethany are good people and I have been honored to know them the majority of my life. I have fought harder for Bethany's rights that anyone else.
6. Even if we were approved for sewer, it DOES NOT MEAN that the zoning changes. It is still AG-1 unless the next owner tries to change the zoning. Thus, unless other properties around ours agree to not only request sewer but also apply for a zoning change, not much can be done. Maybe more houses per acre but that is about it.
7. If folks really don't want us to go the sewer route, then please help us return Bethany to the quiet that we have always known and loved.
8. My suggestions to shut the highschool up are simple:

A. All band practices inside as they intially promised with the drums.
B. Battle of the bands is not allowed at that school due to close proximity of homes.
C. Turning down the speaker system and not YELLING into them.

Do all that, and we are good to go.

9. Finally, even though some who have commented believe they have the right to tell my family what to do with our property, I will NEVER tell anyone what to do with theirs because, quite simply, it is not mine.

Remember, we didn't move to the school - it moved to us.If you want to be angry with anyone, be angry with the Fulton County Board of Education.

Both. There is something known as a pump station.

No, i am not speaking on behalf of my neighbors. Again, if we were to sell with the sewer as an option, what transpires after that is out of our hands.

Bottom line, Council fixes the noise and the whole debate goes away.

Well, the question has still not been answered from Tim about suing the City of Milton if he does not get sewer. He evidently is in town because he has posted the new debate over Cauley and Silva. What is your answer Tim?
