Ethics complaint proceeds against D'Aversa

MILTON - The Milton Ethics Board has decided that the ethics complaint against former Council member Tina D’Aversa has merit and can continue forward to a hearing.

During last year’s election, it was revealed that D’Aversa had e-mailed her rival for District 5, Joe Longoria, and discussed him dropping out of the race. Allegedly, D’Aversa offered Longoria a position on a volunteer board in return for him dropping out. He refused and went on to win the election. D’Aversa maintains that she has done nothing wrong.

The ethics complaint was filed by former Council member Neal O’Brien.

The Ethics Board debated briefly over whether the email in question constituted a potential ethics violation. Of particular interest was the line, "My intention is for you to join a board or committee and to withdraw your application to seek my council position serving from District 5." In the end they unanimously agreed that it does, in fact, meet the requirements to proceed with an ethics investigation.

Ethics Board Chairman Clint Johnson refused to dismiss the complaint on the grounds that doing so would "be telling him [O’Brien] we’re just going to ignore your complaint. The other thing is that the person who is accused ... does not get an opportunity to clear her name."

D’Aversa will get the chance to do just that at the hearing, which is scheduled for Tuesday, Feb. 9 at 6 p.m.

I hope the Ethics Committee is addressing why the people copied on the e-mail, namely the mayor and city manager, did not come forward upon receipt. Read the city charter under the mayor's responsibilities.

Those other two people probably get more e-mail than anyone else at city hall and you're kidding yourself if you think they have time to read each and every one.

You're under the assumption that just because they were copied, then they read the e-mail...bold assumption.

Besides, who are you going to replace the mayor with? He ran unopposed idiot.

If you're so convinced that Lagerbloom and Lockwood should be investigate for being copied on the e-mail, then why don't you man up and file a complaint against them?

It is a practical impossiblity for a subordinate (Lagerbloom) to file against someone who can fire them.
As for the mayor, it is up to your imagination. He is, however, responsible for an email he was copied on unless he can demonstrate non-delivery.
He may well have suggested that plan to his friend Tina anyway, so no big surprise in that case.

If he got in trouble, then you have a special election. If it is really bad, the city would sue the official for cost of spec election.
Easy.
I am sure Julie would run in a heartbeat.

thats doubtful and even if you filed a complaint youd have to prove he read the email like travis said above as receipt is not proof of knowledge

I was not a supporter of Tina's in the last election and I believe our City Council and governance is better off with the current group. She is extremely naive and was certainly over her head on the council. All that being said, she is a tireless community servant who cares for this City.

In our few short years of existence, our City has a long history multiple ethic charges being filed for political reasons. It's time to get past this as a City and a Community. Tina screwed up when she offered Joe a Committee assignment, but this is not a major ethics issue and she really just didn't know better.

I hope the Ethics Committee will rule on this thing quickly, drop it and let the City move on with our important business. In the future, we will all be better off if Ethics complaints are filed for real ethical breaches.

So, how 'bout it, Neal? Why don't you "man up" and file a complaint against Lockwood? This would go a long way toward proving that your complaint was not politically-motivated and engineered to manipulate the election results.

Whether Tina did or did not know actually better, it was her JOB to know better. After all, she VOTED for the ethics ordinance! You would think that she actually bothered to read it first... She really has no excuse here.

I'm sure the Mayor is a crook, but not as big a crook as Susan Thurman. Have you read about the company she invested in that preyed on Soldiers?

The U.S. Department of Justice doesn't take its cues from the timing of Milton elections. The case continues in California. Likewise the Tennessee Attorney General doesn't give a flip about Thurman's re-election. The state just wants its $10.8 million for the loan company being unlicensed and targeting the military.
