3. ZM11-04/VC11-06 - Deerfield Green Subdivision - Redus Atlanta Housing, LLC
requests to modify the following conditions to read:

1d. Site development shall be substantially consistent with the rendering and
elevation submitted to the Fulton County Department of Environment and
Community Development on June 27, 2005 except for lots identified as
136 through 163 on the revised site plan submitted on November 24, 2009
to the City of Milton Community Development Department (ZM09-03);
186 through 220 on the revised site plan submitted on November 3, 2011
to the City of Milton Community Development Department. (RZ05-22)

1f. The minimum heated floor area for a townhouse unit shall be 2,000 square
feet except for those lots identified as 136 through 163 shall be a
minimum heated floor area of 1,850 square feet. All units shall have a rear
entry 2-car garage except for those lots identified as 136 through 163 shall
have a front entry 2-car garage per the revised site plan submitted on
November 24, 2009 to the City of Milton Community Development
Department (ZM09-03); 186 through 220 shall have a front entry 2- car
garage and a minimum heated floor area of 1,850 square feet per the
revised site plan submitted on November 3, 2011 to the City of Milton
Community Development Department. (RZ05-22)

1g. Units 136 through154 provide a minimum of a 20' setback from the back
of sidewalk to the garage door and Units 155 through163; Units 186
through 220 to provide a minimum of a 18 foot setback from the back of
sidewalk to garage door. (RZ05-22)

2a. To the revised site plan received by the City of Milton Community
Development Department on November 3, 2011. Said site plan is not
conceptual; the developer must strictly adhere to the site plan as
submitted. Any changes to the site plan must be approved by the Director
of Community Development and must meet or exceed the requirements of
the Zoning Ordinance and these conditions. Unless otherwise noted
herein, compliance with all conditions shall be in place prior to the
issuance of the first Certificate of Occupancy. (RZ05-22)
To request the following 2 part concurrent variance to1) To reduce the number of
required parking spaces from 18 spaces to 13 spaces for the amenity area (Section 64-
1410); 2) To allow the rear of town home units to exceed 25% cement siding for units
186 through 220 (Section 64-1095 (p)).

I need some help understanding this.

From what I understand, the cryptic agenda items on here related to historic zoning means that any building or lot that was ever used for anything can be reverted to that former use... is that right? This was specifically put onto the agenda for the building on the corner of Thompson and Hopewell. Since the measure was approved, does this mean that they can reopen that store as anything that it has ever been?

There is an ancient gas station on Cogburn... can that now be reopened as a gas station?

There are bunches of old country stores all over the place. Does this open the floodgates for folks to do whatever they want?

Are there rules? Most structures that are deemed "historic" have very strict restrictions put in place. For instance, my grandparents lived in a house that was listed as historic. They couldn't change the paint color, make any architectural additions, etc without approval from a board (which never approved any change at all). Will that be the case here?

Something "historic" means 50 years old. How many structures in Milton will be 50 years old tomorrow to 20 years from now? So essentially as time fly's so anyone can eventually turn any property into anything given enough time, anywhere in Milton. This is the stupidist thing I've ever seen. REally? All just to appease Chatham, half of Council's biggest supporter and campaign contributor? How about the two new guys, how much money did Chatham contribute to their campaigns? Anyone know? Karen Thurman is practically married to David Chatham so she should never be permitted to vote on anything associated with him. Really people!! Oh it won't become C-1 however Chatham will do as he pleases using this bullshit Historical Ordinance. Stupid stupid stupid city council. someone should scare the crap out of them with a lawsuit, it seems thats all it takes to get them to do or not do something. Just look at the gas station debacle on Hwy9 and Francis they all unanimously shot down, then once the law suit was threatened, about face! Wow. We got some weeners in this town!

The guy applying for the gas station filed the lawsuit, duh, you people on this blog are clueless. And Tart was correct at the debate as Lance Large was waist deep in that mess.

So he fits right in as a new council person. This city likes to elect corruption.

The less Knowledgeable people are on the issues the easier it is to misinform them and get their vote. Aka Crooked Creek is Milton's ACORN.

Btw the union did the same thing. it sells alcohol within feet of a school bus stop, which is against city ordinance. Council let that fly before any historical ordinance was ever crafted. they knew a bus stop would be at Haystack. A church was already in so many yards of it, and the corner opposing was also owned by a church. Didn't matter then, ain't gonna matter now.
All because it was at one time a site of a sandwich/burger stand. That is spot zoning smack in the middle of Milton.

Hey but the foods pretty good! No offense to the Union.

So if that restaurant fails, can it be sold to any food chain take over?
