"Free Range" Chickens Lose Battle With County

Owner Cindy Gaines to fence yard rather than "coop them up."

By Hatcher Hurd / Appen Newspapers

Milton Resident Cindy Gaines likes having her chickens running free on her 1.5 acre home on Thompson Road, but when one got in a neighbor's yard, it meant trouble with Fulton County Animal Control.

"The man drove up into my yard about 8:30 at night (May 27) and told me a neighbor had called about one of my chickens disturbing the pine straw in his yard," Gaines said standing in her front yard. "So we're building pens for them now."

But she plans to fence off the front of her yard facing Thompson so that they can still wander the yard. Mostly they congregate under one enormous fir in which they roost at night. In all about 30 chickens patrol the place.

Her land is zoned Agriculture so she didn't see a problem keeping some chickens around the place, something she always had growing up in Alabama, where her grandfather and father farmed. For five years, all was well until one wayward hen started pecking in the wrong place.

According to Fulton County Animal Control Services, Gaine's right to have chickens on her property is not the issue. The citation was issued for not maintaining control of her "livestock."

The animal control officer cited her for the 25 chickens he could count. Now she faces up to a $500 fine. Her neighbor, Preston Collett, has 8 acres behind her house and no problem with birds. He said he likes to get up in the morning and sit in his chair drinking coffee as the roosters start to crow and the hens come out to peck. "It is music to my ears, " he said.

Meanwhile, Gaines will fence the front yard, but she has already spent $600 building some pens in the back. But it goes against her grain. Gaines said she feels chickens should be allowed to roam the property.

"It is like having a garden, seeing those chickens. Why wouldn't you raise chickens letting them walk around?" she asked.

Asked if she contemplated just getting rid of them, she just shook her head. " I'm an Alabama girl. We all keep chickens. We like those fresh eggs every morning. I won't get rid of them, " she said.

09 Election Campaign Kicks Off At Olde Blind Dog

Tuesday, June 16, 2009

It was all smiles and hand shakes at the first official campaign rally for Milton in 2009. Held at The Olde Blind Dog Irish Pub in Crabapple, an estimated 100 plus citizens attended the event.

Coming out in support of each other include all the current incumbents who are up for re-election. They are Mayor Joe Lockwood and Council persons Karen Thurman, Tina D'Aversa, and Bill Lusk. Each echoed the sentiment of support for the other and their desire to move Milton forward while preserving it's "rural character."

align="left">

Belief in one another is a long stride from the 2007 election. Lockwood and D'Aversa were instrumental in ousting former Councilmen Rick Mohrig and Neal O'brien. Both men were heavily supported by Thurman and Lusk. As it would turn out, Alan Tart and Burt Hewitt ended up taking the respected seats. Mohrig, who had initially run unopposed in the 2006 election, would only hold his seat for one year while O'brien was only placed for a mere ten months due to a run-off with long time resident Tim Enloe.

While some believe the unified support is a good move, others aren't so sure. Which begs the question: What do you think? Did the Milton incumbents make the right move or are you bothered by this approach? Have your say today in our comments section below!

Home Invasion Robbery Arrests

On April 18, 2009, a home invasion robbery occurred at 560 Tullamore Way. The victim walked in on two black males that were in the process of burglarizing an office that was located above his garage. The burglary suspects brandished firearms, secured the victim, took several articles, and left the scene.

On May 31, 2009, another home invasion robbery occurred in the City of Alpharetta. A lookout was broadcast regarding a vehicle that was stolen in this robbery. Milton Officer J Wong observed the stolen vehicle on GA 400. When backup officers from the Alpharetta Police Department caught up with Officer Wong, a traffic stop was attempted, and the suspects attempted to elude the police. A vehicle pursuit was initiated and the suspects were followed into the City of Atlanta. The pursuit was terminated when the suspects wrecked the stolen car that they were driving. Demarkus Jamal Grier and Demarcus Enrickya Graham were taken into custody on Alpharetta Police charges.

Milton Detective K Barry was the investigator assigned to the Tullamore Way home invasion case. Because there were similarities in the Alpharetta and Milton home invasions, Demarkus Grier and Demarcus Graham became suspects in the Milton case. Detective Barry’s investigation lead to warrants being issued for Demarkus Grier and Demarcus Graham regarding the Milton home invasion.
Grier and Graham are presently in the Fulton County Jail. Detective Barry charged both suspects with Armed Robbery, Aggravated Assault, Burglary, False Imprisonment, and Possession of a Firearm during the Commission of a Crime.

Milton's Four Horsemen To Kick-Off Re-Election Bids In Joint Rally

by John Fredricks / Beacon Media

What does Milton Mayor Joe Lockwood and City Council members Tina D'Aversa, Bill Lusk, and Karen Thurman have in common? They are all running for re-election - and supporting each other.

In a significant show of electoral solidarity, the four Milton officials are holding a joint kick-off campaign rally on Tuesday night at the Olde Blind Dog Restaurant in Milton. The event is open to the general public. Lockwood, running for a second mayoral term in November, says the joint appearance does not represent a campaign slate. "We are working together to move Milton forward in a positive direction, " Lockwood said. "We may not always agree on every issue, and we may not vote the same way, but we have healthy debate and we respect each other's point of view. I am supporting our entire city council so that we can continue to work together as a team for the benefit of our city."

Lockwood has also gained the endorsement of Milton councilman Burt Hewitt, who he helped elect last year, and sometime-foe Julie Zahner-Bailey for his re-election bid, giving himthe back of at least five of the six members of Milton City Council. The sixth member, Alan Tart, did not return calls. "I support Joe Lockwood for mayor," Zahner-Bailey said.

Lockwood said the city's early reputation for government dysfunction is a thing of the past.

The Vision Thing

Thurman maintained the joint appearance symbolizes a common vision for Milton. "All of us want to maintain the rural charm and character of the city while making sure Milton continues to be financially viable as a municipality," Thurman said "We are working together as a team and Mayor Lockwood is leading us. He deserves our support."

Lusk struck a similar chord. "Whether it be sports, business or government, building a solid team takes time," Lusk said. "It has taken us about three years to get to this point, we have had our bumps in the road along the way, and now we can keep moving Milton forward in a positive way."

D'Aversa, often referred to as the "Queen of Milton" by supports, said,"Milton's most important asset is its citizens , and it's important for all of our elected officials to stand united in working for what is best for our city."

The New Milton

Although no challengers to the four incumbents have come forward to date, the filing deadline for candidates is not until early August. The fact that Lockwood has guided Milton through its early tubulence and a plethora of bad press to gain the support of nearly all of it's once warring council member's is a yeoman's feat, and not to be dismissed. One time Lockwood antagonist, House Majority leader Jan Jones (R-Milton) has even voiced support for him. Lockwood may very well run un-opposed this go-around. Should he get an opponent, he would go into the race as an over-whelming favorite for re-election, especially with Zahner-Bailey's backing. It's tough to argue with Lockwood's mayoral success in 2009, and his bevy of supporters will make mounting a serious challenge to his candidacy a dubious undertaking at best.

Milton Campaign Kick-off Announcement

To permit or not to permit?

By Jason Wright / Appen Newspapers

It's tough to own a small business, of that fact everyone agrees.

But just how much slack should City Council give local business owners who might not be totally up to speed on Milton's regulations?

Take the case of Robert Nestor's American Gardens on Birmingham Highway. Nestor has been operating the small-scale – two trucks that leave in the morning and come back at night, he said – landscaping business for 15 years at the site without complaint from neighbors or much oversight from Fulton County. In January, a Milton code enforcement officer spotted the business and noticed it didn't have the appropriate use permit.

Applying for that permit meant time in front of Planning Commission and City Council – and what Nestor said is thousands of dollars in land surveys. That's because Nestor's current setup runs afoul of Milton's zoning laws, so he is asking for several variances.

It also meant a public meeting where neighbors who had moved next to the business brought up concerns Nestor said he didn't know existed.

"Talk about frustration," said Nestor. "I've been here 15 years and all of a sudden they make me feel like a criminal. I've never had any complaints. I pay my business taxes, do what I have to do. To get a warning notice and then all of a sudden you're in violation – it's shocking when you didn't even know you were violating."

Or take the case of Frank Schaffer's The Landscape Group, which had been operating for more than 18 months on Arnold Mill Road without a proper use permit before being discovered in October 2008 by a Milton code enforcement officer. Schaffer said he assumed everything had transferred over since moving from Roswell in 2006.

Unfortunately, it hadn't, as he needed to get a new use permit to operate legally within Milton.

Both are now in a kind of legal limbo. Schaffer's case is set to be voted upon by council June 15, while Nestor's has been postponed following the results of that aforementioned land survey.

The problem, said Community Development head Alice Wakefield, is that Fulton County's code enforcement division was primarily complaint-based. Since neither bothered their neighbors, no one at Fulton ever realized what was going on – even through Milton's laws on the permits are the same as Fulton.

"The rules and regulations have been there for some time," she said. "But when you become a city, you up the expectation, so there's more scrutiny, more review."

At the April 27 Milton City Council meeting, both cases came before the city's elected officials.

Among the questions of whether or not to allow the variances for existing structures was that serious policy issue: Should longtime business owners be allowed to apply for permits retroactively?

Mayor Joe Lockwood said since the cases have yet to be decided, he couldn't talk about them specifically. He did say, though, that in hypothetical cases like these he believes it is prudent to side with the business owner – especially if no neighbor ever complained to the city.

"We certainly don't want to tell our code enforcement officers not to do their jobs," Lockwood said. "But I feel you have to be reasonable and look at the whole picture. With someone who has been in business for 15 years, you have to treat them differently than someone who is just starting from scratch."

Councilman Alan Tart has a different opinion, however."It is hard for me to buy the story of a large-scale landscaping business that, after being cited for operating illegally, wants to claim they did not know such regulations existed," he said.

He said when a citizen is cited for breaking the law, it's very rare that a judge would drop the charges because they didn't know any better."I do not believe the onus is on the government to expend taxpayer dollars to find [businesses]," he said. "The fact that Fulton County did not have adequate code enforcement coverage in this area prior to the formation of the city is not an excuse."

He also said the businesses are asking for variances to continue operations, and that doesn't sit well, either."Just because they have been doing something a certain way for many years, and this is a convenience for them is no reason to grant variances to our development standards," he said.

Nestor said he doesn't understand that mentality. He's been a longtime resident, and his livelihood depends on being in Milton, he said. "They've got this new town. They want to be proud of it and want people to be a part of it, and they're antagonizing everybody in a lot of different ways – I've heard horror stories," said Nestor. "If I treated my customers like that, I wouldn't have a business."

Nestor also questioned how councilwoman Julie Zahner Bailey, whose family owns Bailey Farms and Gardens on Hickory Flat Road – just a few miles from his landscaping company – could be allowed to sit in on the use permit hearings.

According to city records, Zahner Bailey fills out a full disclosure form prior to landscaping cases detailing how she would not profit by sitting in on the case.

Former and current City Attorneys Mark Scott and Ken Jarrard agreed recusal is not necessary and signed off.

For his part, Schaffer said he just wants to move on from the whole ordeal."I just want to get it over with, get it done and get on with business," he said. "A whole lot has been made out of nothing – we haven't really made a huge impact to anyone around us."

Both Schaffer and Nestor said their mistakes were honest, and that as soon as they were notified, they jumped at the chance to make things right."I thought we've had a really positive response from city council and the mayor," Schaffer said. "It hasn't been all bad – but of course no one's voted."

What is a landscaping business?

Irrespective of the two cases before City Council, Milton's Planning Commission has been looking at revising the city's landscaping business ordinance.

Chairman Paul Moore said in 2006 the city adopted a number of Fulton County's ordinances carte blanche to make sure the city could enforce law. The one that defined a landscaping business was always on the "to-do" list to revisit.

The timing is simply a coincidence, he said."Right now, the problem is there is no clear cut definition for what is a landscaping business," Moore said.Under the law as it is now written, a landscaping business could be a growing operation with a wholesale or retail component or a single truck driven by a team of workers. It could also be a large-scale operation with industrial equipment coming and going at all hours.Such a wide law creates what Moore calls a "sliding scale of impact."

"We have to protect the homeowner from a large-scale business operating in an area that only requires limited buffers [strips of vegetation meant to shield structures]," he said. "However, the rights of the small business owner should be protected, as well. They deserve to put their businesses with other like businesses."

Milton Hosts 2nd Annual Fourth of July Citizens Parade

The whole community is invited to join the event!

Riding the success of last year's Fourth of July Citizens Parade, the City of Milton will continue the new tradition this year. All Milton residents are welcome to decorate bikes, wagons and pets and come help the city celebrate the nation's birthday.

"We had such an incredible turnout last year that we just had to host the event a second time," said Project Coordinator Linda Blow, who came up with the idea of citizens participating last year. "We are determined to make it bigger and better than it was in 2008."

The parade route begins at the corner of Deerfield Parkway and Webb Bridge Road at 10 a.m. Saturday, July 4, and proceeds along Deerfield. Participants are asked to assemble at Milton City Hall, 13000 Deerfield Parkway, at 9:30 a.m. After the parade, come back to City Hall to enjoy balloon animals and face painting. Local Girl Scouts will be selling beverages and Milton's new Philly Pretzel Factory will be selling pretzels.

Save the Date

We will be hosting a Town Hall style meeting to discuss the Crabapple and surrounding area on Wednesday, July 15th at 7:00 pm at the Alpharetta Government Center in Crabapple.

The meeting purpose is to update the community and to get input on items that concern/interest the residents and business owners of the Crabapple, Arnold Mill and surrounding areas. We will be discussing transportation issues, sidewalks and bike paths, the current Crabapple Master Plan, the Historic Preservation Ordinance, proposed plans for the areas, possible library locations, and the long-term viability of this area among other items.

Please pass along this date. Everyone is welcome and encouraged to attend.

Milton Police Sgt. Leaves for African Mission Trip

Milton Police Sgt. Charles Barstow leaves for a 10-day mission trip to Ngamba, Africa, on June 18. Barstow, who has been with Milton's Public Safety Department since it began, will make the journey through his church, North Point Community Church.

According to Barstow, each year North Point hosts a program called GlobalX, which involves mission and service events around the globe. Barstow had heard of the program many times before but was hesitant in the past.

"It was one of those things that had been at the back of my mind for a long time and I always had excuses," said the veteran officer. "Never enough time off from work, not enough money."

But this year was different. After listening to a moving sermon, "Step Outside of Your Comfort Zone," by North Point's Andy Stanley, Barstow began to seriously consider going on a mission trip.

"After Andy's sermon, the idea moved to the forefront. Then when I was challenged by my men's Bible study group, I knew I was ready," said Barstow. "I took Andy's advice and picked a place that I thought would be the farthest outside of my comfort zone."

This will be the first mission trip for Barstow but hopefully not his last. He will travel with 22 other men and women to the Southeast corner of Kenya where they will help people in the local village get water by assisting with irrigation and possibly digging a well.

"The biggest thing I want to accomplish with this trip is kind of a testimony of my faith," said Barstow. "I also want to show that even though America is in economic crisis, we are still a consistently giving country regardless of our circumstances."

Barstow is both nervous and excited about his upcoming journey. "I'm elated and nervous at the same time. I'm excited about going, excited about being able to show my faith and beliefs through my actions but the nervous aspect is the unknown," said Barstow.

"I'm most nervous about my nonstop flight from Atlanta to Nairobi," he jokes.
Barstow hopes that sharing his story publicly will show Public Safety officials in a different light.

"We have a tendency to see police officers as authoritative, inflexible people who may or may not care. Fortunately or unfortunately, we have to keep that facade to stay safe," said Barstow. "But beyond that, we're regular people who care about the community and the world."

Accessmilton's June Person Of The Month

Linda Blow

To see Milton Projects & Events Coordinator Linda Blow in action is to witness a person truly happy in their work. She is always planning well in advance for the five city sponsored events she leads; from the Milton Round Up each Fall to the July 4th citizen parade and everything in between - all with a smile on her face and a go get 'em attitude. We recently sat down with this busy lady to find out a little more about her history, how she came to Milton, and where all that passion comes from.

Linda was raised in a small town of 5,000 in Pennsylvania. When college time arrived, she attended Corning Community College in Corning, New York. Her first job out in the world was with the French's Mustard Company out of Rochester. "I started working on a switch board as a switch board operator," she recently shared.

Linda would eventually make the move to Atlanta. Then about twenty years ago she attended night classes to become a paralegal. After graduation, she worked with various law offices and plaintiff firms. Due to the demands of the job, she would end up mastering the art of multitasking and how to make every hour of each day count. “When we worked on different cases we have to learn different areas of things. We have to learn parts of a car…medical things, we had to become well rounded.” Such experience would end up benefiting her as she made the transition from law to working in government.

About four years ago, she had an itch to try something different. Recent press had come to light about the incorporation of Sandy Springs; an area in which Mrs. Blow was currently living. “I heard that they were looking for an executive assistant to the manager and city manager,” Linda shared. Recent Milton City Manager Aaron Bovos was working at Sandy Springs at the time as the Deputy City Manager and would end up interviewing Linda. Things went better than expected, “Aaron and I hit it off and he hired me and I loved it.”About a year later when Bovos made the move to Milton as the City Manager, Linda was right behind. “When he came up here to Milton I said ‘Aaron I want to come and work for you’ and he said that if I did, I could work with the volunteers. That was it for me. If I could work with people, that is what I wanted. I have met the most wonderful people here in Milton.”

Since her arrival two years ago, Linda has helped bring a lot of happiness and memories to Milton Citizens. From the hot air balloons at the “Milton Round Up” to live reindeer and tasty s’mores around a cozy fire at the “Christmas In Crabapple” event, she harbors a keen sense of what the average family will enjoy and readily promotes it to reality.

She is also a regular fixture at the many city hall meetings; even when her attendance isn’t required, “I go and have had people ask me why do you go to these meetings (when it isn’t required)? Well, because I want to be a part of things and want to know what is going on. I just feel that I would miss something if I didn't go. I try to go to as many as I can.” Linda is also an active member of MDAC (Milton Disability Awareness Committee) and attends every meeting. Talk about being committed to your work!

Experiences have been a plenty when you are as busy as Linda Blow. When pressed for a unique event based story, Linda smiled for a moment and then offered up the following. “I had this very nice man who came in and filled out his application to be part of the memorial day event. God bless him he called me a couple of days before the event and he said 'Linda, I drove by city hall - my name is not out there on those markers.' I said 'Mr. Wall, you don't want your name on there any time soon. I said you have to passover.’ He said "what?’ I said ‘You have to die!’ And he laughed - he said "oh, your right - I guess I don't!’"

As the interview came to a close, she made sure to touch upon some additions to the upcoming Milton Round Up. “We just added the Milton Mayor's Race - a 5k, a 10k a fun run, walk, whatever you want to do. It will start at 9 o’clock that day.” For inquiring minds, the Milton Round Up is scheduled for Saturday, October 17 and will be held at the public schools in Crabapple. Any final words, Projects & Events Coordinator? "I have the best job at Milton City Hall…I just love what I do!" We don’t doubt it, Linda, and thanks for the memories!

ALPHARETTA, Ga. -- Police have released dashcam video of a high speed chase Sunday that led to a fiery crash.

Authorities said it all started when Milton police spotted a stolen black Cadillac Escalade.

Alpharetta police, who have a partnership with Milton police, said the SUV was taken during a home invasion robbery at about 7 a.m. on Club Court in the Enclave at the Golf Club of Georgia subdivision. Authorities said the area is known for its million-dollar homes.

Alpharetta police said three masked men broke into a home and stole electronics.
Then, authorities said, the same gunmen went to another nearby home, broke in and were confronted by the homeowner. Police said the family was held at gunpoint while the men stole TVs, jewelry and cash.

“The family was held at gunpoint for 30 minutes,” said Alpharetta police representative George Gordon.

Police said two of the gunmen fled in the homeowner's black Cadillac Escalade, while another trailed behind in what appeared to be a personal vehicle. The family was not hurt. “We’re grateful that this ended the way it did,” said Gordon.

Police said the suspects, identified as Jamal Grier Damarkus, 18, and Demarcus Graham, 21, both of Atlanta, led authorities on a 25-mile chase down Georgia 400, hitting speeds in excess of 120 mph.

“They thought Sunday was going to be a slow day for police, but we’re let it be known that we are fully staffed all the time,” said Gordon.

Police said the suspects later crashed the vehicle at the intersection of English Avenue and Bankhead Highway in northwest Atlanta, where it burst into flames.
“They lost control … hit an iron fence,” said Gordon.

Investigators said the third suspect was still at large Monday and police were closing in on his whereabouts.

“This robbery group was well organized …they’ve done this type of crime in the past,” said Gordon.

When asked whether the long chase put other drivers in danger, Gordon responded “We’re going to chase them and make them face justice. Our officers are trained in this particular type of driving.”
